Brazil lawsuit claims iPad 3 made intentionally obsolete

Did Apple withhold features from the third-generation iPad, then make the tablet obsolete just six months afterwards by unveiling the iPad 4 ? with the missing items? That?s the accusation being made against Apple?in a class-action lawsuit filed Thursday in Brazil.?At the heart of the lawsuit brought by the Brazilian Institute of Politics and Law Software (IBDI) is the charge Apple released the ?new iPad? in May 2012, then in October introduced the iPad 4 alongside the iPad mini. By updating the processor and other features Apple has produced planned obsolescence?

The lawsuit, first reported by Brazil?s Jornal do Com?rcio?(thanks, Mark R.), alleges Apple conducted unfair business practices, as well as ?planned obsolescence? by introducing the iPad 4 features so soon after the third-gen iPad. Among the features introduced in the iPad 4: a peppier A6X processor, speedier Wi-Fi, broader 4G LTE support, Apple?s new Lightning connectors and an HD FaceTime camera.

?Consumers thought they were buying high-end equipment, not knowing it was already an obsolete version,? the reports quote IBDI attorney Segio Palomares. At the time of the iPad 4?s release, there was much talk of its incremental nature, enough that some Apple Stores allowed iPad 3 customers to exchange their devices for the update, according to AppleInsider.

While talk of planned obsolescence is what?s grabbing headlines, the charge likely making Apple more nervous is allegations of unfair business practices. If the Brazilian court finds Apple guilty, the company could be on the hook for replacing all iPad 3s purchased by Brazilian consumers.

This makes the second product which has drawn Apple into Brazil?s legal system. The smartphone maker is already appealing a decision by a court in Brazil, stripping the iPhone name from Apple.

Although Apple bought the iPhone name from Cisco in 2007, a Brazilian firm now is claiming the ?iPhone? label for its Android-based handset sold in the country. According to reports, the firm IGB in 2008 received the trademark in Brazil for its?G-Gradiente iPhone, which has been selling in Brazil since 2000.

Although it?s unclear how Apple?s appeal will be answered, the company may extricate itself via a hefty licensing payment to use the iPhone trademark in the South American nation.

Current Flu Vaccine Less Effective in the Elderly, CDC Says

Older people who received this season's flu shot appear to be less protected from the illness than younger people who were vaccinated. As a result, early flu treatment is especially important for anyone in this age group who shows flu symptoms, according to a new report from the Centers for Disease Control and Prevention (CDC).

The results show adults ages 65 and over who got this season's flu shot were just as likely to visit the doctor for flu symptoms as older adults who weren't vaccinated.

By contrast, getting the flu shot reduced the risk of visiting the doctor for flu by about 50 to 60 percent in people from other age groups.

Nevertheless, older people are still advised to get a flu shot, the CDC says. The vaccine's effectiveness can vary from season to season, and person to person. During some years, the flu vaccine has been found to provide significant protection for older adults; during other years, no protection has been seen, said Erin Burns, a communications officer at the CDC's Influenza Division.?

The new report only looked at whether this season's flu vaccine reduced the risk of doctors' visits for flu, and didn't examine hospitalizations for more severe flu illnesses. Some research shows that the flu vaccination can reduce the severity of illness in older people who do get sick. A 2011 study found that older people who received a flu shot were 61 percent less likely to be hospitalized for flu-like illness.

"While influenza vaccine is not perfect, overall, the evidence supports the public health benefit of vaccination," Burns said. "Vaccination is particularly important for people 65 and older who are especially vulnerable to serious illness and death, despite the fact that the vaccine may not work as well in this age group."

Because of their increased risk for flu complications, it's important for elderly people to seek treatment quickly if they develop flu symptoms, including fever, cough, body aches, headache, chills and fatigue. Antiviral medications for flu work best if they're given within 48 hours of the start of symptoms.

"Aging and chronic health problems can diminish the body?s ability to mount a protective immune response after influenza vaccination, which can result in lower levels of vaccine effectiveness in some older people," Burns said. But Burns notes that people ages 65 and older are a heterogeneous group, and some individuals have very responsive immune systems.

This year's flu season has been a particularly bad one for the elderly. Of the 8,953?people hospitalized for flu so far, more than half have been 65 or older, the CDC said. [See Why Is This Year's Flu Season So Bad?]

The new report examined the flu vaccine's effectiveness in 2,697 people between Dec. 2, 2012 and Jan. 19, 2013. When considering all age groups, the vaccine was 56 percent effective, meaning it reduced the risk of a doctor's visit for flu by 56 percent. This new estimate for the vaccine's effectiveness is slightly lower than an estimate given earlier this year, which said the vaccine was 62 percent effective.

The flu shot is recommended for everyone ages 6 months and older.

WASHINGTON? -- Staking out his ground ahead of a fiscal deadline, President Barack Obama lashed out against Republicans, saying they are unwilling to raise taxes to reduce deficits and warning that the jobs of essential government workers, from teachers to emergency responders, are on the line.

Obama spoke as a March 1 deadline for automatic across-the-board spending cuts approached and with Republicans and Democrats in an apparent stalemate over how to avoid them.

Obama cautioned that if the $85 billion in immediate cuts -- known as the sequester -- occur, the full range of government would feel the effects. Among those he listed: furloughed FBI agents, reductions in spending for communities to pay police and fire personnel and teachers, and decreased ability to respond to threats around the world.

He said the consequences would be felt across the economy.

"People will lose their jobs," he said. "The unemployment rate might tick up again.?

"So far at least, the ideas that the Republicans have proposed ask nothing of the wealthiest Americans or the biggest corporations," Obama said. "So the burden is all on the first responders, or seniors or middle class families.?

House Republicans have proposed an alternative to the immediate cuts, targeting some spending and extending some of the reductions over a longer period of time. They also have said they are willing to undertake changes in the tax code and eliminate loopholes and tax subsidies. But they have said they would overhaul the tax system to reduce rates, not to raise revenue. Obama did win an increase at the start of the year when Congress increased the upper tax rate for the wealthiest Americans.

"The American people understand that the revenue debate is now closed," House Speaker John Boehner said in a statement Tuesday following Obama's remarks. "Tax reform is a once-in-a generation opportunity to boost job creation in America. It should not be squandered to enable more Washington spending. Spending is the problem, spending must be the focus.?

Obama's remarks came a day after he returned to Washington from a three-day golfing weekend in Florida.

Congress is not in session this week, meaning no votes will occur before next week and complicating the ability to negotiate any short-term resolution.

Obama said the anticipated cuts were already having an effect, noting that the Navy had already delayed the deployment of a carrier to the Persian Gulf.

"Changes like this -- not well thought through, not phased in properly -- changes like this effect our ability to respond to threats in unstable parts of the world," he said.

Obama wants to offset the immediate spending cuts, known as a sequestration in budget language, through a combination of targeted spending cuts and increased tax revenue. The White House is backing a proposal unveiled last week by Senate Democrats that is in line with the president's principles.

But that plan has met an icy reception among Republicans, who oppose raising taxes to offset the cuts.? GOP leaders say the president got the tax increases he wanted at the beginning of the year when Congress agreed to raise taxes on family income above $450,000 a year.

Obama called on congressional Republicans to compromise and accept the Senate Democrats' proposal.

The Democrats propose to generate revenue by plugging some tax loopholes. Those include tax breaks for the oil and natural gas industry and businesses that have sent jobs overseas, and by taxing millionaires at a rate of at least 30 percent.

A spokesman for House Speaker John Boehner said the Ohio Republican agrees the sequester is a bad way to reduce spending, but put the onus for averting the cuts on Democrats.

"A solution now requires the Senate -- controlled by the president's party -- to finally pass a plan of their own," spokesman Brendan Buck said.

Meanwhile, a bipartisan proposal Tuesday by co-chairs of an influential deficit-reduction commission called for reducing the deficit by $2.4 trillion over the next 10 years, with much of the savings coming through health care reform, closing tax loopholes, a stingier adjustment of Social Security's cost of living increases and other measures.

The proposal by former Republican Sen. Alan Simpson of Wyoming and Democrat Erskine Bowles, the former chief of staff for President Bill Clinton, calls for about one quarter of the savings to come from changes in health care programs and another quarter from revenue generated by tax changes.

In their plan, Bowles and Simpson say the automatic cuts scheduled for March 1 are too steep and could set back the economy.

"Sharp austerity could have the opposite effect by tempering the still fragile economic recovery. In order to protect the recovery, the sequester should be avoided and deficit reduction should be phased in gradually," they wrote.

Some Republicans, including House Budget Committee Chairman Paul Ryan, R-Wis., have advocated plugging loopholes, but as part of a discussion on a tax overhaul, not sequestration.

"Loopholes are necessary for tax reform," Ryan said Sunday on ABC's "This Week." `'If you take them for spending, you're blocking tax reform and you're really not getting the deficit under control.?

The sequester was first set to begin taking effect on Jan. 1. But as part of the "fiscal cliff" negotiations, the White House and lawmakers agreed to push it off for two months in order to create space to work on a larger budget deal.

With little progress on that front in recent weeks, Obama is calling for the sequester to be put off again, though it's unclear whether another delay would have any impact on the prospects for a broader budget agreement.

4 dead, including gunman, in Calif. shooting spree

TUSTIN, Calif. (AP) ? The early morning commute was just getting under way on suburban Orange County's network of freeways when Melvin Lee Edwards pulled up to a stop sign near a busy off-ramp.

It was just after 5 a.m. and Edwards, 69, was on his way to work when, police say, a fleeing murder suspect forced him out of his BMW at gunpoint, marched him across the street and shot him three times from behind as horrified commuters watched.

The shooting was the second of three murders in a trail of carnage early Tuesday that spanned 25 miles ? but lasted just an hour. The shooter, 20-year-old Ali Syed, killed a woman in the home he shared with his parents, killed two drivers during carjackings, injured two others and shot up cars on a busy freeway interchange before committing suicide as police closed in, authorities said.

Syed, an unemployed part-time community college student, had no known motive and acted alone, said Tustin police Chief Scott Jordan. The first victim, a woman in her twenties, has not been identified and was not related to Syed, he said.

The violence began at 4:45 a.m., when deputies responded to a call from Ladera Ranch, a sleepy inland town about 55 miles southeast of Los Angeles. They found the woman shot multiple times.

Syed's parents were in the house at the time, fled the residence when shots were fired, and reported it, Jordan said.

From Ladera Ranch, the gunman headed north and pulled off Interstate 5 in Tustin, about 20 miles away, with a flat tire, police said.

A man who was waiting in a shopping center parking lot to carpool with his son saw Syed had a gun and tried to escape in his Cadillac, Jordan said. Syed ran after the car as it drove away and fired his shotgun through the back window, striking the driver in head but not killing him.

The driver "noticed that he was loading his shotgun, so he simply gets back in his car and tries to escape," Jordan said. "He's driving through the parking lot trying to get away and the suspect is actually chasing him on foot, taking shots at him."

Syed then crossed the street to a Mobil gas station, where he approached the driver of a pick-up who was filling his tank and asked for his keys, Jordan said.

"He says something to the effect of, 'I've killed somebody. Today's my last day. I don't want to hurt you. Give me your keys,'" the police chief said. "He hands over the keys and he gets in the truck and leaves."

Syed got back on the freeway, where he pulled to the side of the road at the busy I-5 and State Route 55 interchange and began firing at commuters, Jordan said.

One driver was struck in the mouth and hand. He didn't have a cellphone, but was able to drive home and call police. Two other cars were hit but their drivers weren't injured, Jordan said.

"All of this is happening so quickly," he said, estimating that Syed shot at drivers from the side of the freeway transition for about a minute.

The shooter then exited the freeway in nearby Santa Ana but ran the curb and got his car stuck, authorities said.

He approached Edwards, of Laguna Hills, who was on his way to his Santa Ana business. Syed shot Edwards three times, including in the back of the head and the back, Jordan said.

Onlookers "tried to get away. They saw what was going on, they tried to get away and they called police," he said.

Syed took Edwards' BMW and next popped up at the Micro Center, a Tustin business, where he shot and killed construction worker Jeremy Lewis, 26, of Fullerton. Lewis' co-worker rushed to intervene and was shot in the arm, Jordan said.

Syed took the second construction worker's utility truck and fled to Orange, this time with California Highway Patrol officers in pursuit. He jumped from the moving utility truck at an intersection in Orange, about five miles away, and shot himself in the head, Jordan said.

"There really wasn't a confrontation at the very end," he said. "It happened so quickly."

A shotgun was recovered at the scene and is believed to be the only weapon used.

A message left at Syed's parents' home wasn't immediately returned on Tuesday.

Budget Gimmicks Reduce U.S. Military Readiness

Congress was clueless.

Report after report warned that missions were outpacing resources. But instead of funding the troops, Congress demanded more reports. They dispatched investigators to scrub the books. Some wanted to manage Army operations and logistics from the halls of Congress.

The Joint Chiefs think they have it tough today, but they've got nothing on George Washington. Throughout the Revolution he fought a two-front war -- on one side against the Continental Congress, and on the other against the British.

Forces in Philadelphia were out to get him. Over the course of the war, the Continental Congress created 3,249 committees -- many of them to dog the general's decisions. "Most," wrote historian Thomas Fleming, "with members chosen with little or no reference to their expertise or abilities, which meant they were usually incapable of getting much done."

The back-biting, second-guessing and incompetent micromanagement from Philly had consequences. Exhibit A: Valley Forge. There, in the snow and the bitter cold, Washington's Army lacked the bare essentials. As one general wrote, "men lacked heavy watch coats, half had no blankets and not a few were without shirts." That the Army survived, let alone won the freedom of the new republic, was little more than a military miracle -- a testimony to Washington's remarkable leadership.

Today, the city named after the father of America's Army seems as inept as colonial Philadelphia at managing military affairs. Case in point: the automatic spending cuts required under the Budget Control Act of 2011. More than half of the cuts will come from defense spending, even though defense accounts for less than 20 percent of the budget.

The sequester is a blunt instrument that will ultimately wind up wasting money. Worse, military capabilities and readiness will certainly decline. As one Washington defense expert rightly observed, "It will be impossible to manage these cuts."

Then again, the cuts were never designed to efficiently save money. They were simply a scheme to hold defense hostage so the president could press for higher taxes or, if that failed, blame conservatives for undermining defense by refusing to "compromise" on taxes.

So far, neither side has blinked. The generals and admirals in the Pentagon know, however, that the sequester is just the first skirmish in their budget war. Even without the mandatory cuts, some senior defense officials question if the Pentagon has the resources to fully implement the administration's year-old strategic guidance issued to "sustain global leadership" for the 21st century.

Rather than provide the resources needed to maintain readiness and capability, Washington is pulling a Continental Congress -- supplying the Pentagon with more disruptive ideas. One calls for creating a "national security" budget that lumps State, Homeland Security, Defense and the intelligence community into one funding bucket -- so the government can make "smart" trade-offs. There is an idea whose time has definitely not come. Security instruments aren't fungible. There is no objective way to measure the value of a Stryker battalion against another platoon of diplomats.

Further, lack of accountability -- specifically, Congress' failure to pass a joint federal budget for years -- has helped create the problem. Giving Washington a security slush fund to play with smacks of madness.

Enough with the budget gimmicks and cutesy ideas! How about some old-fashioned adult leadership? Both sides want to blame politics and partisanship for our problems. But the real shortfall is a lack of leaders.

Like the Continental Congress of yore, too many in today's Congress have lost sight of their responsibility to provide for the common defense. Political self-interest, personal vanity and myopic vsion are no way to run an army.

(AP) ? A new North Korean video portrays President Barack Obama and American troops in flames and says the North conducted its recent nuclear test because of U.S. hostility.

The video follows a string of critical rhetoric against the United States. Another video posted earlier this month showed an American city being attacked by missiles.

The most recent video, posted Sunday by a YouTube account affiliated with a pro-reunification government agency, shows a blazing fire superimposed over footage of Obama, and ends with a generic simulation of a nuclear device exploding underground.

The United States currently is negotiating in the Security Council for stronger U.N. sanctions against Pyongyang following a Feb. 12 nuclear test in the far northeast, the country's third since 2006.

It's not just amyloid: White matter hyperintensities and Alzheimer's disease

Feb. 19, 2013 ? New findings by Columbia researchers suggest that along with amyloid deposits, white matter hyperintensities (WMHs) may be a second necessary factor for the development of Alzheimer's disease.

Most current approaches to Alzheimer's disease focus on the accumulation of amyloid plaque in the brain. The researchers at the Taub Institute for Research on Alzheimer's Disease and the Aging Brain, led by Adam M. Brickman, PhD, assistant professor of neuropsychology, examined the additional contribution of small-vessel cerebrovascular disease, which they visualized as white matter hyperintensities (WMHs).

The study included 20 subjects with clinically defined Alzheimer's disease, 59 subjects with mild cognitive impairment, and 21 normal control subjects. Using data from the Alzheimer's Disease Neuroimaging Initiative public database, the researchers found that amyloid and WHMs were equally associated with an Alzheimer's diagnosis. Amyloid and WMHs were also equally predictive of which subjects with mildcognitive impairment would go on to develop Alzheimer's. Among those with significant amyloid, WMHs were more prevalent in those with Alzheimer's than in normal control subjects.

Because the risk factors for WMHs -- which are mainly vascular -- can be controlled, the findings suggest potential ways to prevent the development of Alzheimer's in those with amyloid deposits.

"White Matter Hyperintensities and Cerebral Amyloidosis" was published online February 19 in JAMA Neurology.

The other authors are Frank A. Provenzano, MS (CUMC and Fu Foundation School of Engineering and Applied Sciences); Jordan Muraskin, MS (CUMC and Fu Foundation School of Engineering and Applied Sciences); Guiseppe Tosto, MD (CUMC); Atul Narkhede, MS (CUMC); Ben T. Wasserman, AB (CUMC); Erica Y Griffith, BS (CUMC); Vanessa A. Guzman, BA (CUMC); Irene B. Meier, MSc (CUMC); and Molly E. Zimmerman, PhD (Albert Einstein College of Medicine, NY, NY).

Animal trainer for Flipper and Lassie dies at 69

Pat Derby, a show business animal trainer who worked on the television programs "Flipper" and "Lassie" before becoming an animal rights activist, has died of throat cancer, her organization said.?

Derby, 69, worked on other television shows, including "Gunsmoke" and "Daktari", according to the Performing Animal Welfare Society or PAWS. She was the trainer and spokesperson for the Lincoln Mercury "Sign of the Cat" cougars Chauncey and Christopher, featured in ads.?

Those were among the memorable TV shows and ads of the 1960s and '70s, along with "Flipper", starring a bottlenose dolphin from 1964 to 1967, and "Lassie", starring a series of collie dogs from 1954 to 1974.

Derby became shocked at the neglect and abuse she found in the performing animals business. Her autobiography, "The Lady and Her Tiger" in 1976, was an expose on the harsh treatment of animals in the entertainment industry, according to PAWS.?

Along with her longtime partner Ed Stewart, Derby founded PAWS in 1984 to rescue and provide humane sanctuary for animals from the exotic and performing animal trades.?

With Stewart by her side, Derby died on Friday at her home in San Andreas, California, outside Sacramento, PAWS said in a statement dated Saturday and made available to Reuters on Monday.?

"She was the first to champion the cause of performing animals, and today, because of her tireless work, and fierce determination, most animal protection organizations now have captive wildlife programs that address the issues of performing animals," PAWS said.

Derby testified before Congress twice and served on several state committees setting standards for the care and handling of elephants and other exotic species, PAWS said.?

PAWS said it maintains three sanctuaries for captive wildlife in northern California, providing refuge for more than 100 animals, including elephants, lions, tigers, bears, bobcats, coyotes, leopards, mountain lions, deer and monkeys.

Obama wraps up 3-day Florida golf vacation

President Barack Obama hit the links with a comparatively low-key group of partners on Monday, the third and final day of a Florida golf vacation.

Obama played at the Floridian yacht and golf club, where he spent Presidents Day weekend, with departing U.S. Trade Representative Ron Kirk, the president's Chicago pal Eric Whitaker and White House aide Marvin Nicholson, the White House said.

Tiger Woods was part of Sunday's presidential foursome.

Obama was returning home late Monday, with days to go before a March 1 deadline to stop billions of dollars in spending cuts that could potentially cripple the government from kicking in.

With his wife and daughters away on an annual ski trip, Obama arranged a post-State of the Union, mini-vacation for himself to the exclusive club along Florida's Treasure Coast. The Floridian is owned by Houston businessman Jim Crane, who also owns the Houston Astros baseball team and has donated money to Obama's political campaigns.

Crane and Kirk also played golf with the president on Saturday and Sunday. Obama also got some instruction from Butch Harmon, Woods' former swing coach.

The White House barred media coverage of the president's vacation, but released the names of his golf partners daily.

March 1 is the start date for $85 billion in across-the-board spending cuts, known in Washington as "the sequester," that would drain the money from the Pentagon and other domestic agencies over the next seven months. The White House has warned that thousands of FBI agents, prosecutors, food safety inspectors, air traffic controllers and other federal workers would either be laid off or furloughed.

Obama has called on Congress to pass a smaller package of spending cuts and measures to close tax loopholes to buy time to negotiate a broader agreement. Republicans so far have rejected that idea.

On Friday, Obama was meeting with Japanese Prime Minister Shinzo Abe. Obama telephoned Abe last week to discuss North Korea's recent nuclear test.
